This Privacy Policy describes how Phenomix Sciences, LLC (“Phenomix”, we”, “our”, or “us”) collects, uses, and shares your personal information, and the choices you have in connection with this.  This Privacy Policy applies to Phenomix’s website and the services offered thereon (the “Website”) and its interactions with you.

 

If you have questions about how your protected health information is disclosed by your healthcare provider to Phenomix and how we are permitted to use the protected health information provided to us by your healthcare provider, please refer to your healthcare provider’s HIPAA Notice of Privacy Practices.

 

INFORMATION COLLECTION AND USE

To ensure that we provide you with the best possible experience, we will store, use, and share personal information about you in accordance with this Privacy Policy.  Personal information is information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular user, household or device (“personal information”).  The information that you provide in each case will vary. In some cases, you may be able to provide Personal Information via email or free text boxes, such as contacting us to request further information.  When providing your personal information, please provide only relevant information and do not provide unnecessary sensitive information, such as Social Security numbers, credit card information or other sensitive personal data, unless required for our services. 

 

A.    Information about Website users

As you use the Website, Phenomix will collect your information when you:

  • When you contact us, we collect your identifiers (name, email address, telephone number), any other information you choose to include in your correspondence. We use this personal information to respond to your questions or inquiries and address any issues you may have.
  • When you sign up for an account through the Website, we will collect your identifiers (name, email address, telephone number), and health care provider name. We will use this information to administer your account, provide our services to your healthcare provider, and facilitate the sharing of the results of our services with your healthcare provider as described in INFORMATION SHARING.
  • When you complete a questionnaire on the Website, we will collect your identifiers (name, subject ID, telephone number, email address), protected classification (age, race, gender), health information (weight), site, and the responses to the questionnaires that are required to conduct our analysis and produce your test results.
  • Phenomix may also use this personal information collected for the above purposes to efficiently maintain our business, to comply with the law, and for the limited circumstances described in INFORMATION SHARING.

 

B.    Information about providers

Phenomix makes its services available to healthcare providers. If, as a healthcare provider, you elect to engage Phenomix for our services, we will collect and use your personal information in the following instances:

 

C.    Information about provider end users

In providing services to our client (your healthcare provider), Phenomix may collect, use, share, and store “protected health information” received from a client who is a “covered entity” as the “business associate” of our client (as such italicized terms are defined by the Health Insurance Portability and Accountability Act of 1996, as amended, and its implementing regulations). As a business associate, Phenomix cannot use or disclose protected health information in a way that our client itself may not. For information on how our client collects, uses, shares, and stores your protected health information, please refer to their Notice of Privacy Practices.

 

D.    Cookies

Phenomix also collect information from you automatically as you use the Website via cookies. Cookies are small pieces of text sent to and stored by your browser. We use first-party cookies, which are cookies that we place on your browser, and third-party cookies, which are cookies that we allow third-parties to place on your browser through our Website.

The Website utilizes essential, functional, and analytics cookies to collect your information. This information includes:

  • Information on your interaction with and usage of the Website, such as pages visited, time spent on each page, what you click on, and frequency of access;

We do not combine the information collected through the use of Google Analytics with personally identifiable information. Google’s ability to use and share information collected by Google Analytics about your visits to our Website or to another application which partners with Google is restricted by the Google Analytics Terms of Use and Privacy Policy. To prevent your information being used by Google Analytics, you can download the Google Analytics opt-out browser add-on.

In general, to disable cookies and limit the collection and use of information through them, you can set your browser to refuse cookies or indicate when a cookie is being sent. When you opt-out, an opt-out cookie will be placed on your device. The opt-out cookie is browser and device specific and will only last until cookies are cleared from your browser or device.

 

INFORMATION SHARING

Phenomix does not sell or lease your personal information to any third party. Phenomix may share the personal information identified in this Privacy Policy for business purposes in the following instances:

  • Where necessary, Phenomix will share your personal information within Phenomix to efficiently carry out and improve our business and to the extent permitted by law.  
  • Phenomix will share personal information with service providers that perform services on Phenomix’s behalf. These service providers include our IT support, email vendor, and blood testing vendor.
  • Phenomix will share the results of our analysis with your healthcare provider.
  • In the event that Phenomix enters into, or intends to enter into, a transaction that alters the structure of Phenomix, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our assets, Phenomix would share your personal information with third parties, including the buyer or target (and their agents and advisors) for the purpose of facilitating and completing the transaction. Phenomix would also share your personal information with third parties if Phenomix undergoes bankruptcy or liquidation, in the course of such proceedings.
  • Phenomix will share your personal information where legally required, such as in response to court orders, law enforcement or legal process, including for national security purposes; to establish, protect, or exercise our legal rights; to defend against legal claims or demands; to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person; or to comply with the requirements of any applicable law.

 

YOUR CHOICES AND SELECTING YOUR PRIVACY PREFERENCES

We want to provide you with relevant information that you have requested. When possible, we will provide options as to what information we collect and how you can manage any preferences that pertains to such information.

If we provide subscription-based services, such as email newsletters, we will allow you to make choices about what information you provide at the point of information collection or at any time after you have received a communication from us while you are subscribed.  Transactional or service-oriented messages, such as delivery confirmation, enhancements, updates, and other operational messages, are usually excluded from such preferences, as such messages are required to respond to your requests or to provide goods and services, and are not intended for the purposes of marketing.

We may send you email newsletters and marketing emails and messages.  You may opt out of them at any time by selecting the “unsubscribe” link at the bottom of each email or contacting us directly.  Please note that by opting out or unsubscribing you may affect other services you have requested we provide to you, in which such communication is a requirement of the service provided.

 

CORRECT OR VIEW YOUR INFORMATION

You can access your Phenomix account to correct or view certain personal information of yours in our possession and which is associated with your account. 

 

DO NOT TRACK

The Website does not support Do Not Track (DNT). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.

 

INFORMATION SECURITY

Phenomix implements and maintains reasonable security measures to protect the personal information Phenomix collects and maintains. These security measures include Secure Sockets Layer/Transport Layer Security (SSL/TLS) and access controls. However, no security measure or modality of data transmission over the Internet is 100% secure and Phenomix is unable to guarantee the absolute security of the information collected from you.

 

AGE RESTRICTION

The Website is not intended for use by individuals under the age of eighteen (18).

 

CHANGES TO THIS PRIVACY POLICY

Phenomix may change this Privacy Policy from time to time and will post the changes to this page and indicate the date the changes go into effect. We encourage you to review the Privacy Policy to stay informed. If Phenomix make changes that materially affect your privacy rights, we will notify you with a prominent post on the Website and obtain your consent, if required.
